Terms & Conditions
Melanie Weigel (“Company”) agrees to provide our various programs and services (“Program") to paid members ("Client"). Client agrees to abide by all policies and procedures as outlined in this agreement as a condition of their participation in the Program.
We invite you to access and use our websites (“Websites”). We provide visitors to our Websites (“Visitors”) access to the Websites subject to the following Terms of Use, which may be updated by us from time to time without notice to you. By accessing and using the Websites, or purchasing a product or service, you acknowledge that you have read, understood, and agree to these Terms of Use. If you do not agree to any of these terms, then please do not use the Websites or Programs.
Description and use:
We provide Visitors and Clients with access to the Services as described below.
Visitors: those who do not register with us, but want to explore the Websites. No login is required for Visitors. Visitors can view all publicly-available content on the Websites and email us.
Clients: Clients can do all the things that Visitors can do, and may also purchase products and services through Websites; access exclusive content available only to Clients; receive services based on agreed upon package; access and manage their own personal accounts on the Websites; receive program-related emails, alerts, and other notifications; attendprogram-related coaching sessions; schedule one-on-one or team Zoom calls; and become a part of our communities.
We are under no obligation to accept any individual as a Client and may accept or reject any registration at our discretion. In addition, we may deactivate any account at any time, or any reason, including without limitation if it determines that a Client has violated these Terms of Use or a contract we have in place.
Independent Contractor Status:
If Client is signing up for services to be provided, we will work as independent contractors. In no event shall any person from our team be deemed employees of the other party. Because of this, a separate contract will be required before the service start date. We require the contract to be signed and the first invoice to be paid before any work begins.
Scheduling:
For services, we are able to schedule a weekly, bi-weekly, or monthly recurring meeting as needed. However, because we need to focus on our work, task list, and plan our days ahead of time, we do not accept meeting requests with less than 24 hour notice. If you need to speak with us on the phone or via Zoom for any reason, please do not call directly unless it's an emergency, reach out via email or Slack and we can schedule a time.
Responsibility:
We will do everything possible to support you in achieving your desired results and outcomes, however you are responsible for all change in your life. Client accepts and agrees that Client is 100% responsible for their progress and results from the Program.
We can work with you to identify solutions, offer suggestions, options, and advice -- but you accept full responsibility for all decisions, courses of action, outcomes, and success.
Guarantee:
Company makes no guarantees verbally or in writing. Client understands that because of the nature of Program, the results experienced by each client may significantly vary. Client acknowledges that as with any business endeavor, there is a risk of loss of capital and there is no guarantee that Client will reach their goals as a result of participation in the Program. Program education and information does not purport to be, nor should it be construed as, specific advice tailored to any individual.
Company assumes no responsibility for errors or omissions that may appear in any program materials, however feel free to let us know if something seems to be missing from the program materials or is incorrect, and we will do our best to address it.
Community Guidelines:
You will not upload, post, email, transmit, or otherwise make available any content that: infringes any copyright, trademark, right of publicity, or other proprietary rights of any person or entity; or is defamatory, libelous, indecent, obscene, pornographic, sexually explicit, invasive of another’s privacy, promotes violence, or contains speech that attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status, and/or sexual orientation/gender identity; or discloses any sensitive information about another person, including that person’s email address, postal address, phone number, credit card information, or any similar information.
You will not use our communities to attempt to sell your services to others, spam or use the Websites to engage in any commercial activities. If you post content, you will stay on topic, be helpful, and be kind. You will not use the Websites to collect any market research for a competing business.
You will not interfere with or attempt to interrupt the proper operation of the Websites through the use of any virus, device, information collection or transmission mechanism, software, or access or attempt to gain access to any data, files, or passwords related to the Websites through hacking, password or data mining, or any other means.
Please let us know about inappropriate content of which you become aware.
Confidentiality:
The Company respects Client’s privacy. Any confidential information shared by Client will stay confidential. We agree not to disclose, reveal, or make use of any Confidential Information or any transactions. Client will NOT reveal any information to a third party including but not limited to; names, email addresses, company titles or positions, phone numbers, or addresses.
In group coaching settings, Clients may learn information about eachother. Client agrees not to use such confidential information in any manner other than in discussion with other participants.
Restrictions:
The Websites are only available for individuals aged 13 years or older. If you are 13 or older, but under the age of majority in your jurisdiction, you should review this Agreement with your parent or guardian to make sure that you and your parent or guardian understand it. Our paid Programs are only for those 18 years of age or older.
Login Information:
During the registration process for Clients, we will ask you to create an account, which includes a username, a password, and may also include additional information that will assist in authenticating your identity when you log-in in the future. When creating your account, you must provide true, accurate, current, and complete information.
Each username and password can be used by only one Registered User, and sharing your access credentials with others is a breach of this Agreement. You are solely responsible for the confidentiality and use of your username, password, and unique identifiers, as well as for any use, misuse, or communications entered through the Websites. You will promptly inform us of any need to deactivate or change your login or other personal information. We reserve the right to delete or change your account information at any time and for any reason and shall have no liability to you for any loss or damage caused by such action.
Payments:
You shall pay all applicable fees and taxes for any purchases or agreed upon services in full.
You must provide current, complete, and accurate billing and credit card information. You must promptly update all billing information (such as billing address, card number, and expiration date) to keep your account current, complete, and accurate, and you must promptly contact us if your credit card is lost or stolen, or in the event of a breach of account security. We reserve the right to charge any renewal card issued to you to the same extent as the expired card.
We reserve the right to attempt to reprocess failed payments at any time. In the event of non-payment for over 40 days, we will process the balance due on your credit card, bank account, or other approved payment method you provided during the registration process for the full payment of the fees and any applicable taxes. We may disable your account access until balance is paid in full, and even if we disable your account the balance is still due. Your account may be reinstated once paid.

Cancellation & refund policy:
Coaching programs, courses, and low-cost offers: we do not accept cancellations. If you wish to be removed from the program, please let us know and we will disable your account, however you are still responsible for any outstanding balances.
Memberships: you may cancel your membership access and any future payments with 14 days written notice. Please email us at support@melanieweigel.com to cancel.
Services: you may end the contract on a service within 14-days written or verbal notice. Please email us at support@melanieweigel.com or discuss with us on a call.
We do not process refunds on any program or service for any reason.
If you are unhappy with your results, we may discuss either staying in your current program to give you more time to work through it; an additional coaching call to work through your current biggest struggle; or possibly providing additional services at no additional charge (up to 2 weeks maximum). These will be on a case-by-case basis and we will need to discuss the options with you before anything is agreed upon.
All payments will be charged and made in U.S. dollars.
Intellectual Property:
All Content is protected under both United States and foreign laws. Unauthorized use of the Content may violate copyright, trademark, and other laws. Visitors may view all publicly-available Content for their own personal, non-commercial use. Clients who have purchased any product or service, may download onto their own machines and view any Content contained in such purchased product or service for their own personal, non-commercial use. Other than as expressly set forth in the immediately two prior sentences, you have no other rights to the Content.
No other use is permitted without prior written consent. The use or posting of the Content on any other website, social media page, or in a networked computer environment for any purpose is expressly prohibited. If you violate any part of this Agreement, your permission to access and/or use the Content and the Websites automatically terminates and you must immediately destroy any copies you have made of the Content.
External Sites:
Websites may contain links to third-party websites. The content of External Sites is developed and provided by others. You should contact the site administrator for those External Sites if you have any concerns regarding links or any content. We are not responsible for the content of any linked External Sites and do not make any representations regarding the content or accuracy of materials on such External Sites. You should take precautions when downloading files from all websites to protect your computer. If you decide to access linked External Sites, you do so at your own risk.
Termination of the Agreement:
We reserve the right, in our discretion, to restrict, suspend, or terminate this Agreement and your access to all or any part of the Websites, at any time, for any reason without prior notice or liability. We reserve the right to change, suspend, or discontinue all or any part of the Websites at any time without prior notice or liability.
